Termination, close claims, impaired convictions, doing business in an area that is unpopular with standard insurers: your case is denied or overpriced to the point of becoming unsustainable. The sub-standard market — also known as the “aggravated risk market” — was designed exactly for this situation. This guide explains how it works for auto, home and business, what it costs, and how to get out of this market when your profile becomes favourable again.
Substandard car insurance
Since automobile liability is mandatory in Quebec, no driver with a valid licence can be left without coverage. When private insurers refuse your file, there are two ways:
Track 1
Private Specialty Market
Insurers such as Wynward, Everest, Optimum or some Lloyd’s programs accept difficult auto files (2-3 claims, recent termination, conviction). Higher premium but comprehensive coverages available.
Track 2
Facility Association
Mechanism of last resort across Canada. Guarantees mandatory liability to any driver with a valid license. Reserved for files refused elsewhere; highest premium on the market.
Impairment: concrete impact on the premium
A conviction for impaired driving (alcohol, drugs) is the heaviest reason for an additional premium on the market. The premium typically increases from $1,200/year to $4,000 – $6,000/year for 3 to 6 years. Some programs require the installation of an interlock device, mandatory or voluntary, which can reduce the premium by 15-25%.
Licence suspension: don’t drive, don’t cancel your policy right away
During a suspension, no insurer covers the vehicle while driving. But if the vehicle is parked (garage, yard), reduced coverage (fire, theft, vandalism) is still possible and avoids losing insurance history. Talk to a broker before cancelling — resumption after suspension is easier if continuity is maintained.
Substandard Home Insurance
Home insurance is not mandatory in Quebec (except for mortgage requirements), but the absence of coverage exposes you to catastrophic losses. Common reasons for refusal:
- Extensive claims history (2-3 water damage or fire in 5 years)
- Non-compliant property (roof > 25 years, oil heating not maintained, fused electrical panel)
- Remote second home (cottage in a hard-to-reach area, poorly served by firefighters)
- Prior termination by another insurer
- Short-term rental use (Airbnb without an appropriate endorsement)
The solution is through specialized insurers (often via Lloyd’s Canada) who accept the property with mitigation measures : new roof, replacement of the electrical panel, installation of connected water detectors, alarm, sprinklers. Documenting these investments to the broker reduces the premium.
Substandard Business Insurance
Some industries almost always go through the aggravated risk market — regardless of the company’s history:
Construction & contractors
General, roofing, excavation, demolition: high exposure to site risk.
Catering with fatty cuisine
Commercial fryer, grill, wok: increased fire risk. Ansul extinguishing system mandatory.
Garages and mechanical workshops
Handling of flammable fluids, vehicles on deposit, professional liability.
Heavy transport & taxi
High mileage, value of goods transported, significant third-party liability.
Canadian insurers in the aggravated risk market (Trisura, Everest, Wynward, Lloyd’s) require a detailed file: site plan, prevention equipment, procedures, complete history, turnover. A specialized broker prepares this file and submits it to several insurers — the difference in premium between the first and the best received can be as much as 30-50%.

How to Place a Substandard Folder in 4 Steps
Document the situation
Notice of termination, claims file, judgments if applicable, history with all insurers of the last 6 years.
Describe the mitigation measures put in place
Interlock immobilizer, alarm, sprinklers, connected water detectors, operating procedures, training. These can reduce the specialized premium by 10-25%.
Submission to several specialized insurers
A broker with access to Lloyd’s Canada, Wynward, Everest, Trisura, Optimum and others compares the proposals — the difference can be as high as 30-50%.
Annual review to return to standard market
As soon as the analysis window (3 to 6 years) excludes adverse events, the broker tries the standard market again. Potential savings: several thousand dollars per year.
💡 The key tip
Don’t wait until the end of the sub-standard contract to shop around
Each year that your file remains clean, the analysis window decreases by the same amount. After a threshold (often 3 years after the last adverse event), some standard insurers agree to take over the risk. A broker reviews your file annually to seize the first favourable moment — you don’t stay overpriced for a year too long.
⚠️ NEVER DO
Never hide a termination, a claim, a conviction or a reason for an additional premium when you requote. False declaration is a reason for retroactive nullity of the contract: at the time of the loss, the insurer can refuse compensation in full and recover the premiums paid. What seems “cunning” in the short term becomes catastrophic in the event of a claim.
